Phase 2

Activities for this phase may include: 
  1. Development of demonstrative and evidentiary exhibits that capture juror interests in the trial story, as identified and measured in earlier research; 
  2. Witness Assessment: Using jury-based, empirical techniques we assess the abilities of key witnesses to carry the trial story and evaluate other related problems in testimony; 
  3. Written analysis and recommendations generated from earlier research activity--the optimal jury will be modeled and a script of potential questions with rationale for strikes or desirability will be prepared for review prior to jury selection;
  4. Recommendations on themes for indoctrinations in the voir dire process; and 
  5. Consultation as permitted during the actual voir dire. We will assist in picking juries based on the objective and subjective results of prior efforts which provide a unique basis for recommendations in this phase. 
We can provide advice on juror deselection. Our main objective, however, is to assist you in better telling the client's story at trial. There is scant objective evidence to suggest the information about jurors available to attorneys at the start of trial is sufficient to account for anything more than a small proportion of variances in outcome. There is evidence to suggest jurors tell less than the full truth in voir dire. We can tell you why and how biases may influence your case.
